Terms of Service

This agreement is a legally binding contract between you and Aqua (referred to as the "Service," "we," "us," or "our"). By registering for an account, purchasing subscriptions or credits, or using any part of the service, you agree to these terms.
1. Acceptance of Terms
By accessing or using Aqua, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree, you must stop using the service.
2. Description of Service
Aqua provides online tools and developer APIs to help you create, polish, and export App Store screenshots and icons. Available features depend on your subscription tier, credit balance, or one-time credit purchases. We may modify, suspend, or discontinue any part of the service at any time.
3. Eligibility and Accounts
You must be at least 18 years old or the age of majority in your jurisdiction to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorized use.
4. Billing, Subscriptions, and Credits
Subscriptions: Starter, Builder, and Factory plans are billed monthly through our payment processor. Subscriptions renew automatically until canceled. You may cancel at any time from your billing dashboard.
Credit Packs: One-time credit packages can be purchased to add credits to your account. Unused credits roll over month to month while your account remains active. Credits have no cash value outside the service and are non-refundable except where required by law or as described below.
Usage and Refunds: Credits are consumed when you generate icons or screenshots through the dashboard or developer APIs. If a paid generation request fails on our side, we will refund the associated credits to your account automatically where applicable.
Refund Policy: Except as required by law or for failed generations described above, payments are non-refundable. If you cancel a subscription, you keep access to subscription benefits until the end of the current billing period.
5. Developer API
Aqua offers developer APIs and SDKs for programmatic asset generation. You are responsible for safeguarding your API keys and for all usage associated with them. You may not share API keys, exceed the limits of your plan, or use the APIs in a way that disrupts or degrades the service for others.
API documentation describes request formats, credit costs, and usage limits. We may update API behavior or availability with reasonable notice when practicable.
6. Intellectual Property and Content Ownership
Your Uploads: You retain all rights in the assets, screenshots, text, prompts, and other content you submit. You grant us a limited, worldwide, non-exclusive license to host, process, modify, and store your content solely to provide the services you request.
Your Outputs: Outputs generated for you, including polished screenshots and icon assets, are owned by you, subject to your compliance with these terms and any third-party rights in your source materials. We claim no ownership over your generated assets.
AI Processing: Aqua may use automated and AI-assisted features to generate outputs from your content and instructions. We do not use your uploads, prompts, or generated outputs to train our own models.
Our Proprietary Materials: The Aqua application, brand, software, and documentation are our property or that of our licensors and are protected by applicable intellectual property laws.
7. Prohibited Activities
You may not use the service to create or process unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable content. You may not circumvent security controls, abuse rate limits, interfere with the service, upload malicious code, or attempt to reverse engineer the application except where applicable law expressly permits it.
8. Termination
We may suspend or terminate your account and access to the service if you violate these terms or engage in activity that harms other users or the service. You may stop using the service at any time.
9. Disclaimer of Warranties
The service is provided on an "as is" and "as available" basis. Aqua disclaims all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free, or that generated assets will meet App Store review requirements.
10. Limitation of Liability
To the maximum extent permitted by law, Aqua will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. In no event will our total liability exceed the amount you paid to Aqua in the twelve months preceding the event giving rise to liability.
11. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to these terms must be resolved exclusively in the state or federal courts located in San Francisco County, California.
12. Updates to Terms
We may revise these Terms of Service from time to time. The current version will be posted on our website. By continuing to use the service after revisions take effect, you agree to the updated terms.
